British Judge to Rule on Pinochet Appeal

A British judge will rule Monday on whether the Belgian government and six human rights groups can go to court to seek access to former Chilean dictator Augusto Pinochet's medical test results.

The parties are seeking a judicial review of the government's decision to keep secret a medical report that it says shows Pinochet, 84, is not fit to be extradited to Spain on torture charges.

Home Secretary Jack Straw has said he will not release the independent doctors' report on the grounds of normal patient-doctor confidentiality.

He allowed interested parties to make representations before making a final decision, but Belgium and the rights groups argue they are hamstrung by Straw's refusal to release the report.

"We have been denied sight of the medical report and we say as a matter of fundamental fairness we need to see it in order to make meaningful representations," Belgian government lawyer Presiley Baxendale said Thursday.
