Clinic Injunction Remains in Effect

A court injunction preventing Moscow's U.S. Global Health clinic from soliciting some corporate clients of the American Medical Center remains in effect following a North Carolina judge's refusal to lift the restriction.

Officials of PepsiCo, which owns part of U.S. Global Health, had hoped State Judge D. Marsh McLelland would lift the injunction Wednesday when he signed an order dismissing part of AMC's case against U.S. Global Health.

An AMC lawyer, Garret Rasmussen, said Friday the judge's decision "is concrete evidence that Pepsi's claims that it won the case are overstated."

The two sides differed Friday in their interpretation of what happened at the hearing. Rasmussen said the injunction would remain in effect unless the North Carolina Court of Appeals decided otherwise, which he termed "unlikely."

However, the general manager of U.S. Global Health, Jim Gerwin, said the judge had scheduled Jan. 30 to consider lifting the injunction.
